Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and trs.media, trading as AI Winning ("AI Winning", "we", "us"). By using this website, buying a guide or using AI Winning Publisher (together, the "Services"), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

2. The Services

• Digital guides: downloadable guides about e-commerce, AI tools and running a business with an AI assistant: the E-com Guide, the AI Guide, the Jarvis Guide and the Combination Pack.
• AI Winning Publisher: an internal tool used by our media team to upload and publish approved short videos to TikTok accounts whose owners have connected it through Login with TikTok.

3. Eligibility

You must be at least 18 years old and able to enter a binding contract. If you use the Services for a company, you confirm that you are authorized to accept these Terms for it.

4. Digital guides

• When you buy a guide, you get a personal, non-exclusive, non-transferable license to download and use it for your own purposes.
• You may not resell, share, publish or redistribute a guide or its templates, in full or in part, without our written permission.
• Prices are shown in US dollars on the website. The price that applies is the one shown at checkout at the time of your order.
• We may update a guide. Buyers may download updated editions of a guide they bought at no extra cost.

5. Payments and refunds

Online checkout is not open yet. When it opens, payments will be processed by a third-party payment provider under its own terms.

Guides are digital content delivered immediately. If you are a consumer in the EU, you have a 14-day right of withdrawal, but you lose it once the download starts if you expressly agreed at checkout to immediate delivery and acknowledged that you would lose the right. If a file is damaged, incomplete or does not match its description, email us within 30 days of purchase and we will fix it or refund you. This does not affect any rights you have under mandatory consumer law.

6. No guarantee of results

Our guides are for education and information only. They describe methods, tools and the way their author works. They are not financial, legal, tax or business advice. We do not promise or guarantee any income, sales, profit, followers or other result. Your results depend on many factors, including your own effort, skills, budget and market conditions. Any examples are illustrations, not typical or expected outcomes.

7. AI Winning Publisher, TikTok and YouTube

Login with TikTok

To use AI Winning Publisher, the account owner signs in through TikTok's official login screen and chooses which permissions to grant. We never ask for or store TikTok passwords. The data we receive and how we use it are described in our Privacy Policy.

Only approved content is posted

• AI Winning Publisher uploads or publishes a video only after the account owner has previewed the video, its caption and its privacy setting and has expressly confirmed it.
• AI Winning Publisher never posts automatically, never posts content that was not approved, and never likes, comments, follows, sends messages or deletes anything on a TikTok account.
• Posting may fail or be delayed because of TikTok's limits, reviews or outages. We will show the status TikTok reports, but we do not control TikTok.

Disconnecting

You can remove AI Winning Publisher's access at any time in your TikTok settings, or by emailing trs.media@outlook.com. To have your data deleted, follow the steps in the Privacy Policy; we complete deletion requests within 30 days.

TikTok's terms

When you use AI Winning Publisher you must also follow TikTok's Terms of Service, Community Guidelines and any rules on branded or AI-generated content. AI Winning is not affiliated with, sponsored by or endorsed by TikTok.

YouTube

AI Winning Publisher uploads our own approved videos to our own YouTube channel through the YouTube API Services. By using a connected channel you agree to the YouTube Terms of Service; Google's data practices are in the Google Privacy Policy. Access can be removed at any time on the Google security settings page. AI Winning is not affiliated with, sponsored by or endorsed by YouTube or Google.

8. Your content

You keep all rights to the videos and captions you upload. You give us a limited permission to store, process and send that content to TikTok only for the purpose of publishing it as you approved. This permission ends when the content is deleted from our systems. You confirm that you own or have permission to use everything in the content you approve, including music, images and people shown, and that it does not break any law or TikTok rule.

9. Acceptable use

You agree not to use the Services to:

• post content that is illegal, misleading, hateful, harassing, sexual involving minors, or infringes anyone's rights;
• connect a TikTok account you are not authorized to manage;
• send spam or manipulate engagement;
• try to break, overload, reverse engineer or gain unauthorized access to the Services or TikTok.

We may suspend access to AI Winning Publisher if we reasonably believe these rules are being broken.

10. Intellectual property

The website, guides, templates, design and the AI Winning name and logo belong to us or our licensors. Except for the license in section 4, these Terms give you no rights to them.

11. Third-party services

The Services rely on third parties such as TikTok, our hosting provider and, once live, our payment provider. Their services are governed by their own terms and privacy policies, and we are not responsible for them.

12. Disclaimers

The Services are provided "as is" and "as available". To the extent the law allows, we make no warranties beyond those stated in these Terms, including about uninterrupted availability or that the guides suit your particular purpose. Nothing in these Terms limits warranties or rights that cannot be excluded under consumer law.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profit, lost revenue or lost data, and our total liability to you for any claim related to the Services is limited to the amount you paid us in the 12 months before the claim, or 100 US dollars if you paid nothing. This does not limit liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law.

14. Ending use

You may stop using the Services at any time. We may stop offering any part of the Services or end your access if you break these Terms. Sections 4 (license limits), 6, 8, 10, 12, 13 and 15 continue to apply after use ends.

15. Governing law

These Terms are governed by the laws of the Netherlands. Disputes go to the competent courts of the Netherlands, unless mandatory consumer law gives you the right to bring a claim in the courts of the country where you live.

16. Changes to these Terms

We may update these Terms. The "Last updated" date shows when. If a change materially affects users of AI Winning Publisher, we will tell them before it takes effect. Continuing to use the Services after a change means you accept the updated Terms.
